    Terms of Service

    Agreement

    Osoft or Osoft Inc. and its employees (hereinafter referred to as "We, Us, Our") AND you (hereinafter referred to as "Customer, Client, User, You").


    If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms and conditions, in which case the term "Customer, Client, User, You" shall refer to such entity.


    1. Terms

    By accessing https://osoft.org or using any service, product, or digital element provided, sold, developed, maintained, supported, or advised by Osoft Inc., you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations.


    If you do not agree, you are prohibited from using or accessing any Osoft website, service, product, infrastructure, or software, including those developed, maintained, consulted, sold by Osoft Inc. for any platform (web, mobile, wearable, or smart TV etc.).


    2. Data Collection & Use

    By using any service, product, or digital element provided, sold, developed, maintained, supported, or advised by Osoft Inc., you acknowledge that Osoft Inc. may collect, use and process the following personal and business data including but not limited to:


  • Personal information: full names, addresses, phone numbers, email addresses, dates of birth, SIN or SSN, and other personal informations.
  • Payment information: debit/credit card details, banking information, and other payment credentials.
  • Financial information: bills, invoices, receipts, statements, banking information, and other financial informations.
  • Property/asset information: vehicle details, real estate, or financial asset data.
  • Business information: business/corporate registration, operational details, financial or employee information, and other business informations.
  • Customer-submitted data: any information collected through any input fields, booking forms, CRM, HRM, ERP systems, digital services, e-mail, texts, SMS, website or applications integrated, developed, maintained by Osoft.
  • Domain information: registrant details and administrative contacts, and other domain magement related informations.
  • Server & hosting data: any files, applications, database, or information stored or processed on our or client's servers and/or on third-party service providers.
  • Digital communication data: Email/SMS/Voice/Video/Text message contents and metadata.
  • Cloud data: files in connected services (e.g., Google Drive, OneDrive, Azure, Digital Ocean).
  • Climate data: weather, temparature and other environment informations.
  • Health data: medical and other health informations.
  • Usage data: product/service purchases, using periods, usage analytics and other usage data.
  • Social Media data: account informations, photos, files, contents and other data.
  • Third-party information & data: Any third-party information or data collected from our clients or from the users of our clients.
  • Any customer data collected when customer accessed and/or used any of our services/products or any services/products of our clients. (e.g. IP Address, Device information, Location, Browser data, Cookies, etc.)

  • You are responsible for ensuring data accuracy and obtaining any necessary consents from users or customers before sharing data with us.


    3. Remote Device Monitoring and Control Services

    Osoft provides technologies for clients to:


  • View device screens in real-time.
  • Monitor on-screen activities and user actions.
  • Remotely control devices, execute commands, or power devices on/off.
  • Access, create, modify, or delete device data.

  • Client Responsibility: You must have legal authority and user consent before using these services.


    Disclaimer: Osoft Inc. is not responsible for any misuse of these tools or legal violations arising from client activities, cyber attacks, data loss, system vulnerabilities or any applicable limitations.


    4. Booking System and Appointment Services

    Osoft Inc. offers booking systems that automates scheduling, notifications (via email/SMS), and cancellations.


    Client Responsibility:

  • Ensure lawful collection and use of customer data.
  • Obtain customer consent when collecting sensitive information (vehicle, asset, personal or financial data).
  • Ensure payment of service fees.

  • Limitations:

  • We are not liable for missed notifications or failures or losses caused by inaccurate data entry, server issues, system misconfigurations, email/SMS delivery issues, or third-party gateway failures, service terminations.

  • 5. Domain Registration and Management Services

    We offer domain registration, transfer, and renewal services.


    Client Responsibility:

  • Keep domain records updated and ensure payment of renewal fees.
  • Monitor expiration dates to prevent accidental domain loss.
  • Keep domain management account access and login credentials safe.

  • Limitations:

  • Osoft Inc. is not liable for missed renewals, accidental deletions, transfers, configuration errors, cyber attacks, unauthorized access, compromised acccounts, system vulnerabilities and failiurs.

  • 6. Server Resources and Hosting

    We provide hosting, storage, and server infrastructure for websites, applications, and data.


    Client Responsibility:

  • Maintain backups unless otherwise specified in a contract.
  • Ensure hosted content complies with laws.
  • Ensure server resources are not being used for illegal purposes.
  • Ensure timely payment of service fees.

  • Limitations:

  • Osoft Inc. is not liable for user modifications, data loss, downtime, unauthorized access, compromised accounts, damages resulting from cyberattacks, system vulnerabilities, updates, dependencies, plugins, hardware failures, or third-party provider malfunctions or outages.

  • 7. Email and Cloud Services

    We provide email and cloud services via third-party vendors (Google Workspace, Microsoft 365, Yandex 360, etc.).


    Client Responsibility:

  • Manage mailbox content and comply with anti-spam and privacy regulations.
  • Ensure stored or transmitted contents complies with laws.
  • Ensure timely payment of any service fees.

  • Limitations:

  • We are not responsible for data loss, downtime, or business disruptions caused by third-party services or user modifications.

  • 8. Custom IT Services and Maintenance

    Osoft provides on-demand IT services based on contracts or hourly terms, including but not limited to:


  • Setting up or repairing office computers, mobile devices, printers, phone lines, or IVR systems.
  • Installing, updating, or uninstalling software.
  • Malware scans, system resets, and device wipes.
  • Service Migrations (e.g., e-mail migration, server migrations)
  • Network setup and troubleshooting.
  • Remote support and troubleshooting.
  • Scheduled and emergency support for IT systems.
  • Other custom IT support and services.

  • Client Responsibilities:

  • Provide clear access, instructions, and consents.
  • Secure and backup all sensitive/important informations and data before service.

  • Limitations:

  • Osoft is not liable for data loss, hardware failure or business interruptions caused by or during IT services and maintenance.
  • Services are best-effort with no long-term guarantee unless specified in a contract.

  • 9. Technicial Support for Websites and Applications

    We provide ongoing technical support for websites and applications we have developed.


    Support Services include:

  • Bug fixes, troubleshooting, and patching.
  • Security updates and software upgrades.
  • Performance optimization and feature enhancements.

  • Limitations:

  • Support is based on maintenance contracts or hourly terms.
  • Osoft is not liable for downtime, business interruptions, data loss, or issues caused by Technicial Support or resulting from third-party integrations, user modifications, or external service outages.

  • 10. Website & Custom Application Development

    We develop Corporate websites, eCommerce stores, CRMs, HRMs, ERP systems, Mobile apps and custom frontend/backend applications for vairous platforms.


    Client Responsibilities:

  • Provide accurate requirements/specifications.
  • Approve deliverables in scope.
  • Maintain site/app content after handover (unless specified in a contract).

  • Osoft is not liable for:

  • Misuse, unauthorized changes, user modifications, system vulnerabilities, third-party plugin failures.
  • Client dissatisfaction outside agreed scope.

  • 11. Use License

    Permission is granted to temporarily download one copy of Osoft Inc.’s website materials for personal, non-commercial viewing only.


    You may not:

  • Modify, copy, or use materials commercially.
  • Reverse engineer or decompile any software.
  • Remove copyright notices or proprietary markings.
  • Transfer or mirror materials on another server.

  • This license terminates automatically if violated.


    12. Disclaimer

    All Osoft Inc. services and content are provided "as is", without warranties of any kind, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.


    We do not guarantee:

  • Error-free or uninterrupted service.
  • Accuracy or completeness of content.
  • Legal compliance of client usage (e.g., device monitoring or data collection).

  • 13. Limitations

    Osoft Inc. shall not be liable for:

  • Data breaches, data loss, or unauthorized access.
  • Service interruptions, downtime, or system errors.
  • Business losses due to missed notifications, hosting failures, or third-party provider issues.
  • Intigration of third-party services/products.
  • Damages caused by misuse or illegal use of our services.
  • Any indirect, incidental, special, or consequential damages.

  • 14. Accuracy of Materials

    We do not guarantee that the information on our services, websites, apps, or platforms is complete, accurate, or current. Osoft Inc. may update content at any time without notice.


    15. Links

    Osoft Inc. is not responsible for the content of external websites linked on our platform, services, websites, applications. Use of such sites is at your own risk.


    16. Return / Refund Policy

    All payments follow our Refund Policy. Refund eligibility varies by service and contract terms.


    17. Termination of Service

    We may suspend or terminate any service for violations of these Terms or non-payment, without notice. Osoft is not liable for resulting losses. If any service is terminited, it will not be eligible for refund.


    18. Modifications

    These Terms may be updated without prior notice. Continued use of services implies acceptance of the revised terms.


    19. Governing Law

    These Terms are governed by Canadian law.
    Disputes are subject to the exclusive jurisdiction of Canadian courts.
